These Terms of Service (the “Terms”) govern access to and use of the website located at traditionwear.com, including all related pages, checkout flows, customer accounts, and online storefronts (the “Site”), and the purchase of products offered through the Site. The Site is owned and operated by Lucus Garcia, doing business as Tradition Apparel, Tradition Wear, and TRDTN Apparel (the “Company,” “we,” or “us”). The Company has operated the Site since 2020.

By accessing the Site, creating an account, or placing an order, you agree to be bound by these Terms, the Privacy Policy, the Shipping Policy, the Return and Refund Policy, and the Legal Notice, each of which is incorporated by reference. If you do not agree, you may not use the Site or purchase products from the Company.

1. Eligibility

You represent that you are the age of majority in your jurisdiction, or that you are the age of majority and have authorized a minor dependent to use the Site under your supervision. You may not use the Site for any unlawful purpose or in violation of these Terms or applicable law.

2. The Site and the Platform

The online store is hosted by Shopify Inc., which provides the e-commerce platform through which the Company offers products for sale. The Company is the seller of record. Shopify is not a party to the contract of sale between you and the Company.

The Company may modify, suspend, or discontinue any aspect of the Site, including products, prices, features, and promotional offers, at any time. The Company shall have no liability to you or to any third party by reason of such modification, suspension, or discontinuance.

3. Accounts

If you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activity occurring under the account. You shall provide current, complete, and accurate information and shall promptly update that information as necessary to permit the Company to process transactions and communicate with you. The Company may refuse, suspend, or terminate an account or an order at any time, including where the Company reasonably believes the order is fraudulent, abusive, placed by a reseller, or otherwise inconsistent with these Terms.

4. Orders, Pricing, and Payment

An order submitted through the Site constitutes an offer to purchase. The Company may accept or reject any order, in whole or in part, in its discretion. Acceptance occurs when the Company confirms the order and charges the designated payment method, or when the Company releases the goods to the carrier, whichever occurs first.

Prices, descriptions, and availability are subject to change before acceptance. The Company may limit quantities sold per person, per household, per payment method, or per address. If the Company cancels or modifies an accepted order, the Company will attempt to notify you using the contact information provided at checkout and will refund amounts paid for goods that will not be shipped.

You authorize the Company and its payment processors to charge the payment method you provide for the purchase price, applicable taxes, and shipping charges. You represent that you are authorized to use that payment method.

5. Products

Certain products may be offered only through the Site and in limited quantities. Product images are representative. The Company does not warrant that colors, textures, or measurements displayed on your device will match the delivered goods. Apparel sizing is approximate. You are responsible for reviewing size information on the applicable product page before purchase.

The Company does not warrant that any product will meet a particular athletic, training, or competitive purpose, or that use of any product will prevent injury. Fightwear and training apparel are used at the customer’s own risk and in accordance with ordinary principles of safe training.

Returns and exchanges are governed exclusively by the Return and Refund Policy then posted on the Site.

6. Shipping and Risk of Loss

Shipment, delivery estimates, title, and risk of loss are governed by the Shipping Policy. Delivery to the address supplied at checkout, as reflected in carrier records, constitutes delivery to you.

7. Acceptable Use

You shall not:

(a) use the Site in any manner that violates law or the rights of any person;

(b) transmit malware, harmful code, or unsolicited commercial messages;

(c) attempt to gain unauthorized access to the Site, other accounts, or related systems;

(d) scrape, harvest, or index the Site by automated means except as permitted by a written robots protocol or by prior written consent of the Company;

(e) reproduce, resell, or commercially exploit the Site or any portion of it without prior written consent; or

(f) impersonate the Company or any other person.

A violation of this Section may result in immediate termination of access and may be referred to appropriate authorities.

8. Intellectual Property

The Site and all content on it, including text, photographs, graphics, logos, product imagery, and compilation, are owned by the Company or used under license. TRADITION APPAREL, TRADITION WEAR, TRADITION FIGHTWEAR, TRDTN APPAREL, TRDTN, and related names, marks, logos, and trade dress are trademarks, service marks, or trade names of the Company. No license is granted except the limited, revocable right to access the Site for lawful personal or internal use in accordance with these Terms.

9. User Content

If you submit reviews, comments, photographs, or other content (“User Content”), you grant the Company a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, display, adapt, and distribute that User Content in connection with the Site and the Company’s products and marketing. You represent that you own or control all rights in the User Content and that it is accurate and lawful. The Company may remove User Content at any time.

10. Third-Party Services and Links

The Site may include links to, or integrate, third-party websites, tools, and payment or shipping services. Those third parties are not under the Company’s control. The Company does not endorse and is not responsible for third-party content, terms, or practices. Your use of third-party services is at your own risk and subject to the third party’s terms.

11. Privacy

Collection and use of personal information are described in the Privacy Policy. Electronic communications relating to your account and orders may be sent to the address you provide. Transactional messages are not marketing and may be sent even if you have opted out of promotional mail.

12. Disclaimer of Warranties

THE SITE AND ALL PRODUCTS AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. THE COMPANY DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT PRODUCTS WILL MEET YOUR EXPECTATIONS.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES. IN SUCH JURISDICTIONS, THE FOREGOING EXCLUSIONS APPLY TO THE FULLEST EXTENT PERMITTED.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY THE LAWS OF THE STATE OF COLORADO, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SITE, THESE TERMS, OR ANY PRODUCT PURCHASED THROUGH THE SITE, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY’S TOTAL LIABILITY ARISING OUT OF OR RELATING TO ANY ORDER OR TO THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO THE COMPANY FOR THE PRODUCTS GIVING RISE TO THE CLAIM.

NOTHING IN THESE TERMS LIMITS ANY LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW, INCLUDING LIABILITY FOR FRAUD OR FOR PERSONAL INJURY CAUSED BY THE COMPANY’S GROSS NEGLIGENCE OR WILLFUL MISCONDUCT TO THE EXTENT SUCH LIMITATION IS PROHIBITED.

14. Indemnification

You shall indemnify, defend, and hold harmless the Company and its owners, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or relating to your use of the Site, your breach of these Terms, your User Content, or your violation of law or of the rights of any third party.

15. Termination

The Company may terminate or suspend access to the Site, any account, and any pending order at any time, with or without notice, if the Company believes you have violated these Terms or that continued access presents risk to the Company, other customers, or the platform. Sections that by their nature should survive termination shall survive, including intellectual property, disclaimers, limitation of liability, indemnification, and governing law.

16. Governing Law and Venue

These Terms and any dispute arising out of or relating to the Site, these Terms, or any transaction conducted through the Site shall be governed by the laws of the State of Colorado, without regard to conflict of laws principles. Subject to any non-waivable consumer protection rights that may apply, exclusive jurisdiction and venue shall lie in the state or federal courts located in the State of Colorado.

17. Changes

The Company may revise these Terms by posting an updated version on the Site. The effective date below will be updated accordingly. Continued use of the Site after posting constitutes acceptance of the revised Terms. If you do not agree, you must discontinue use.

18. Miscellaneous

These Terms, together with the policies referenced herein, constitute the entire agreement between you and the Company concerning the Site and supersede prior understandings on that subject. If any provision is held unenforceable, the remaining provisions shall continue in full force. Failure to enforce any provision is not a waiver. You may not assign these Terms without the Company’s prior written consent. The Company may assign these Terms in connection with a sale of assets, reorganization, or similar transaction. Headings are for convenience only.
